Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and MealMath ("MealMath," "we," "us," or "our") and govern your access to and use of the MealMath mobile app, website, and related services (together, the "Service").

By creating an account, or by downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. By using the Service you represent that you meet this requirement.

You are responsible for the accuracy of the information you provide, for keeping your account credentials secure, and for all activity that occurs under your account. Notify us promptly at support@mealmath.ai if you suspect unauthorized use.

MealMath is a cost-optimization and meal-planning tool. It is not a medical device, and it does not provide medical, nutritional, dietary, or other professional health advice.

Meal plans, macro and calorie targets, TDEE estimates, nutrient figures, and any other output are generated automatically from data you and third parties supply, and are provided for general informational purposes only. They are not a substitute for advice from a qualified physician, registered dietitian, or other licensed professional.

Always consult a qualified professional before starting, stopping, or changing any diet, exercise, supplement, or medical regimen — especially if you are pregnant or nursing, have an eating disorder, diabetes, an allergy or intolerance, or any other medical condition. Never disregard or delay professional advice because of something you read or generated in the Service.

You are solely responsible for verifying that any food, ingredient, or plan is safe and appropriate for you, including checking product labels for allergens and accurate nutrition information. If you experience a medical emergency, call your local emergency number immediately.

Apple Health and connected data. If you grant permission, the Service reads metrics such as body weight and energy expenditure from Apple Health to estimate your energy needs and personalize plans. You can revoke this access at any time in your device settings. How we handle this data is described in our Privacy Policy.

Prices, product availability, nutrition facts, and other store data are collected from third-party sources (including retailer websites and public food databases) and may be incomplete, out of date, estimated, or incorrect.

We do not guarantee that any price, product, or nutrition value shown in the Service matches what you will find in-store or online at the time of purchase. Confirm prices and nutrition information at the point of sale before relying on them.

The Service lets you create and submit content — including custom foods, food overrides (price and nutrition corrections), barcodes, nutrition data and images, recipes, meal plans, preferences, and feedback ("User Content"). You retain ownership of your User Content.

Private by default. Your custom foods, food overrides, saved meal plans, and preferences are stored against your account and used to operate, provide, and personalize the Service for you. We do not make this content publicly available or attribute it to you to other users.

Foods you submit for review. If you choose to submit a food for review (for example, to add a missing product), you are asking us to include it in our shared, publicly readable food catalog. If the submission is accepted, the food data — and limited submission metadata — may be added to that catalog and made available to all users of the Service. Do not submit a food for review unless you are comfortable with it becoming public.

License to operate the Service. For all User Content, you grant MealMath a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, transferable, and perpetual license to host, store, reproduce, modify, adapt, translate, aggregate, publish, and otherwise use that content to operate, provide, secure, improve, and promote the Service.

Deidentified and aggregated data; research and machine learning. We may create deidentified and aggregated data from your User Content and your use of the Service (data that no longer identifies you). You agree that we may use this deidentified and aggregated data for any lawful purpose, including research, analytics, and the development, training, and improvement of machine-learning models, datasets, features, and new products and services. Because deidentified and aggregated data does not identify you, it is not associated with your account and is not subject to deletion or to the restrictions on personal data.

Survival and deletion. The licenses above survive termination of your account to the extent your User Content has been incorporated into the public catalog, into backups, or into deidentified or aggregated datasets and models. You may request deletion of identifiable User Content as described in our Privacy Policy, and we will honor such requests where reasonably practicable and legally required.

Your warranties. You represent and warrant that you have all rights necessary to submit your User Content and to grant the licenses above, and that your User Content does not infringe any third-party right or violate any law.

You agree not to:

•Use the Service for any unlawful purpose or in violation of these Terms;

•Reverse engineer, scrape, or attempt to extract source code or bulk data from the Service except as permitted by law;

•Interfere with, disrupt, or overload the Service or its infrastructure;

•Upload content that is false, infringing, malicious, or that you do not have the right to share; or

•Resell, redistribute, or commercially exploit the Service or its data without our prior written consent.

The Service, including its software, optimization engine, design, text, and branding, is owned by MealMath and protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use.

All rights not expressly granted to you are reserved by MealMath.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

TO THE FULLEST EXTENT PERMITTED BY LAW, MEALMATH DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ITS DATA OR OUTPUT WILL BE ACCURATE, COMPLETE, OR RELIABLE.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

TO THE FULLEST EXTENT PERMITTED BY LAW, MEALMATH AND ITS OFFICERS, EMPLOYEES, AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, HEALTH OUTCOMES, OR SAVINGS, ARISING OUT OF OR RELATED TO YOUR USE OF — OR INABILITY TO USE — THE SERVICE.

WITHOUT LIMITING THE ABOVE, MEALMATH IS NOT LIABLE FOR ANY DAMAGES OR HARM ARISING FROM A MEAL PLAN, FOOD RECOMMENDATION, NUTRITION OR PRICE FIGURE, OR ANY OTHER OUTPUT OF THE SERVICE, INCLUDING ANY ADVERSE HEALTH OR ALLERGIC REACTION, OR ANY PURCHASE YOU MAKE IN RELIANCE ON THE SERVICE. YOU USE MEAL PLANS AND ALL OTHER OUTPUT AT YOUR OWN RISK.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

You agree to indemnify and hold harmless MealMath from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.

You may stop using the Service at any time. You may request deletion of your account and associated personal data by contacting us at support@mealmath.ai; deletion is also subject to the "Deidentified and aggregated data" terms in Section 5. We may suspend or terminate your access to the Service at any time if you violate these Terms or if we discontinue the Service.

Sections that by their nature should survive termination — including content license (to the extent described above), intellectual property, disclaimers, limitation of liability, and indemnification — survive.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the revised Terms.

These Terms are governed by the laws of [GOVERNING_JURISDICTION — e.g. State of California, USA], without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located there for any dispute not subject to arbitration or small-claims resolution.
